Commissiond’enquêtecitoyennesurlerôledelaFrancedanslegénocidedesTutsiauRwandaCommuniqué,le7juillet2006ÀPROPOSDEL'IMPLICATIONFRANÇAISEDANSLEGÉNOCIDEDESTUTSIDURWANDAEN1994DesvictimesrwandaisesdugénocideperpétréauRwandaen1994ontsaisile16février2005laJusticefrançaisedeplaintespourcomplicitédanscegénocide.Ellesaffirmentquedesmilitairesfrançaisauraientdirectementparticipéauxcrimesdontellesontsouffert.LaChambredel'instructiondelaCourd'appeldeParisvient,pourlasecondefoisenmoinsdedeuxmois,dedéjouerlesmanœuvresretardatricesduProcureurmilitaire.Eneffet,aprèsavoirsoutenuquelesconstitutionsdepartiecivileétaientfantaisistesetavoirdemandéauJuged'instructiondeserendreàKigalipours'assurerdeleursolidité;aprèsavoirfaitappeldel'OrdonnanceduJuged’instructionquidéclarait,contresesréquisitions,lessixplaintesrecevables;leProcureurduTribunalauxArméesdeParisavaitrequisl'annulationdesauditionsauxquellesleJuged'instructionavaitprocédésursapropredemandeàKigali.Le29mai2006,laCourd'appelavaitconfirmélarecevabilitédetouteslesconstitutionsdepartiecivile.Le3juillet2006,elleaconfirmélavaliditédesauditionsfaitesàKigaliparleJuged’instruction.Désormais,onpeutespérerquel'instructiondessixplaintescontrexpourcomplicitédegénocide,pourraenfinêtremenéesereinement.Toutefois,l'éventuelleconstatationparlaJusticedeviols,desévices,voiredemeurtrescommissurleterraindugénocideparcertainsmilitairesfrançais,peutconstituerunleurre.Eneffet,dansleurgrandemajorité,lesmilitairesprésentssurleterrainn'ontpascommisd'actesdecegenre.Ilsontexécuté,pourlaplupartentoutebonnefoi,lesinstructionsquileuravaientétédonnées.Or,danslamesureoùcesinstructionsenjoignaientenréalitéauxtroupesdeporterassistanceauxautoritéslocalesalorsquecesautoritésperpétraientungénocide,ilfautconsidérerqu'ellessontàl'originedelacomplicitéreprochéeauxFrançais.Eneffet,l'assistanceainsifournieétaitunecomplicitédegénocide-mêmelorsqu'ellenes'accompagnaitpasdeviols,desévicesetdemeurtres.Maisilestévidentquelaresponsabilitépremièredecetteassistance-commedesviols,sévicesetmeurtresquil'auraient,parfois,accompagnée;doncl'ultimecomplicitédegénocide,incombeauxauteursdesinstructionset,parconséquent,auxpouvoirscivilsquicoiffentlahiérarchiemilitaire.Danscesconditions,laCommissiond’enquêtecitoyenne(CEC)considèrequ'ilseraittropfacilededédouanerlesvéritablesresponsablesaudétrimentdequelqueslampistes.Elleconsidèreégalementquelaquestiondesresponsabilitésessentiellesresteraitposéemêmesil'instructionn'établissaitpaslamatérialitédesméfaitsévoquésparlesplaignants.Enfin,ellesuggèrequ'encestempsdedébatspréélectoraux,lesdifférentscandidatesetcandidatsàlacandidaturesoientappelésàprendreclairementpositionsurlesresponsabilitésdesdirigeantsdel'Étatdansl'assistanceaccordéeen1994auxauteursdugénocidedesTutsiduRwanda.Contactpresse:OlivierThimonier,tél:0144610325,olivier.thimonier@survie-france.org
